Solar on leased premises fails for one reason: misaligned incentives. The solution is a clean contractual architecture built around three documents: PPA, Roof License, and Tripartite NOC.
1. Tenant Pays
Signs PPA. Pays for power consumed.
2. Landlord Allows
Signs Roof License. Gets green value.
3. Solar Co Owns
Installs & Maintains asset.
Step 1: Lock Down Roof Rights
The agreement must specify the exact demarcated area, access timing, and waterproofing responsibilities. This protects the landlord's asset.
Step 2: Address Tenant Churn
In Jaipur and Bhiwadi, businesses move. We plan for it with Novation (transfer to new tenant), Buyout, or Removal options pre-defined in the contract.
Checklist Before Signing:
- Is lease duration aligned with PPA term?
- Is roof integrity baseline documented?
- Is there a single responsible party for O&M?
